Abstract:

This research aims to comprehensively explore the multidimensional factors influencing enforcement and compensation effectiveness in cross-border intellectual property (IP) violations. By integrating cultural variances, technological complexities, legal remediation frameworks, economic impacts, and political dimensions, the study seeks to offer a holistic understanding of the challenges inherent in global IP protection. The primary purpose is to bridge the gaps in existing literature by examining the interconnectedness of these factors and their collective influence on enforcement strategies and compensation mechanisms. Employing a qualitative approach, this research conducted semi-structured interviews with 11 stakeholders, achieving data saturation. A three-step thematic analysis was employed to unravel insights into cultural variances, technological complexities, legal frameworks, economic implications, and political dimensions shaping cross-border IP violations. The study amalgamated empirical findings with existing literature to develop a comprehensive understanding of the multidimensional aspects influencing enforcement and compensation in this domain. The thematic analysis revealed the intricate interplay between cultural nuances, technological challenges, legal complexities, economic implications, and political influences within cross-border IP violations. Cultural variances significantly impact perceptions of IP rights, while technological advancements pose challenges in enforcement. Legal frameworks and economic ramifications further shape enforcement effectiveness, with political will playing a pivotal role in global IP protection. This research offers theoretical and practical implications by integrating diverse dimensions influencing cross-border IP violations. The study's originality lies in its comprehensive approach, providing insights into the interconnectedness of factors influencing enforcement and compensation strategies, guiding policymakers, legal entities, and businesses in formulating robust global IP protection strategies.
